This Privacy Policy describes how Benesol, Inc. (SOLIUS) and our subsidiaries and affiliated companies (collectively, “SOLIUS,” “we,” or “us”) collect, use, and disclose information about you. This Privacy Policy applies to information we collect when you access or use our websites, mobile applications, devices, and other online products and services that link to this Privacy Policy (collectively, our “Services”), or when you otherwise interact with us, such as through our neighborhood locations or customer support channels, or on our social media pages. We may provide different or additional notices of our privacy practices with respect to certain products or services, in which case this Privacy Policy will not apply. In this Privacy Policy, “personal information” means information about an identifiable individual, or information that when combined with other, readily available information, may be used to identify an individual.

COLLECTION OF INFORMATION

Information You Provide to Us

We collect personal information you provide directly to us. For example, we collect personal information when you create an account, get a treatment, make a purchase, fill out a form (i.e., to sign up for a mailing list or download a white paper), communicate with us via third-party platforms, participate in a contest or promotion, request customer support, or otherwise communicate with us.

This personal information may include:

  • Contact Information: your name, email address, postal address, phone number, and country.

  • Skin Information: information about your skin type/conditions/issues.

  • Payment Information: if you make a purchase, we work with a third-party payment processor to collect and process your payment information. We do not store your payment card number(s) or other payment card details.

Information We Collect Automatically

We automatically collect certain personal information about your interactions with us or our Services, including:

  • Treatment Information: We collect information about your treatment history, such as the date/time you received treatment, the dosage you received, and information about your skin type based on your reaction to the treatment.

  • Transactional Information: When you make a purchase or return, we collect information about the transaction, such as product details, purchase price, and the date and location of the transaction.

  • Device and Usage Information: We collect information about how you access our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, browser type, and app version. We also collect information about your activity on our Services, such as access times, pages viewed, links clicked, and the page you visited before navigating to our Services.

  • Information Collected by Cookies and Similar Tracking Technologies: We (and those who perform work for us) use tracking technologies, such as cookies and web beacons, to collect information about your interactions with the Services. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. USE OF INFORMATION

We use the personal information we collect to provide treatments and maintain your account. We may also use the personal information we collect to:

  • Provide, maintain, and improve the Services, including to debug and repair errors in our Services;

SHARING OF INFORMATION

We share personal information in the following circumstances or as otherwise described in this policy:

  • We share personal information with vendors that access personal information to perform work for us, such as companies that assist us with web hosting, shipping and delivery, payment processing, fraud prevention, customer service, and marketing and advertising.

  • We may disclose personal information if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.

  • We may share personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of SOLIUS, our users, the public, or others.

  • We share personal information with our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.

  • We may share personal information in connection with, or during negotiations concerning, any merger, sale of SOLIUS assets, financing, or acquisition of all or a portion of our business by another SOLIUS.

  • Personal information may be shared between and among SOLIUS and our current and future parents, affiliates, and subsidiaries and other companies under common control and ownership.

  • We share personal information with your consent or at your direction.

  • We also share aggregated or de-identified information that cannot reasonably be used to identify you.

ADVERTISING, TRACKING, AND ANALYTICS

We engage others to provide analytics services and serve advertisements across the web and in mobile apps. These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of our Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, and conversion information. This information may be used by SOLIUS and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites, and better understand your online activity.

We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics may set cookies on your browser or mobile device or read cookies that are already there to collect information. Google Analytics may also receive information about you from apps you have downloaded that partner with Google. Google Analytics collects information about how you use our Services. We use the information provided by Google Analytics to improve our Services.

By using our Services, you consent to the processing of data about you by Google as described here and in Google’s privacy policy. You can control the information provided to Google and opt out of certain ads provided by Google by using one of the methods set forth in http://www.google.com/policies/privacy/partners/ or the Google Analytics opt out browser add-on at http://tools.google.com/dlpage/gaoptout?hl=en.

We also work with third parties to serve ads to you as part of customized campaigns on third-party platforms (such as Facebook and Instagram). As part of these ad campaigns, we or the third-party platforms may convert information about you, such as your email address and phone number, into a unique value that can be matched with a user account on these platforms to allow us to learn about your interests and serve you advertising that is customized to your interests. Note that the third-party platforms may offer you choices about whether you see these types of customized ads.

TRANSFER OF INFORMATION TO THE UNITED STATES AND OTHER COUNTRIES

 SOLIUS is headquartered in the United States and we have operations and vendors in the United States and other countries. Therefore, we and those that perform work for us may transfer your personal information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction. Where required by law, we provide adequate protection for the transfer of personal information in accordance with applicable law, such as by entering into appropriate contracts with our vendors.

Account Information

You may update and correct certain account information at any time by logging in to your account or contacting us. If you wish to deactivate your account, please contact us, but note that we may retain certain information as required by law or for our legitimate business purposes.

CANADIAN RESIDENTS

If you are a Canadian resident, this section applies to you.

Consent: By submitting personal information to SOLIUS, or our service providers and agents, you consent to the collection use, disclosure, and transfer of your personal information in accordance with this Privacy Policy and as permitted or required by law. You may withdraw your consent at any time to the collection, use, disclosure, or transfer of your personal information time by contacting SOLIUS at info@SOLIUS.com. If you withdraw your consent (or if you decide not to provide certain personal information), you acknowledge that SOLIUS may not be able to provide you, or continue to provide you, with certain products, services, or information that may be of value to you.

Retention of Personal Information: The personal information that you provide will be retained by SOLIUS in accordance with applicable laws. However, we will take reasonable steps to destroy or permanently de-identify personal information we hold if it is no longer needed for the purposes for which it was collected.

Access and Correction: SOLIUS will take reasonable steps to ensure the personal information we hold is accurate, complete and up-to-date. Upon your written request, and subject to certain exceptions provided by law, SOLIUS will inform you of the existence, use, and disclosure of your personal information and give you access to that information. SOLIUS may charge a minimal fee for providing such access to you. If you believe that the personal information that SOLIUS holds about you is not accurate or complete, you may write to SOLIUS at info@SOLIUS.com. If you are able to establish that the information is not accurate or complete, SOLIUS will take reasonable steps to delete and/or correct the information so that it is accurate, complete, and up-to-date. In order to facilitate a request to correct or update information, SOLIUS may ask you to provide additional information to confirm your identity. Any such information will only be used for the purpose of confirming your identity and will not be retained by SOLIUS.

Canada’s Anti Spam Law (“CASL”)

We will only send you commercial electronic messages (“CEMs”) where we have your express or implied consent to do so. Your consent to receive CEMs is implied where we have an existing business relationship with you, or you have reached out to us and made an inquiry within a certain time frame. You may unsubscribe from receiving CEMs at any time, by clicking the unsubscribe button on an email or following the direction provided in a text message. We may also send you transactional emails, which do not require consent.
